WebLitchi Terms of Service

Welcome to WebLitchi.com. By accessing our website, signing up for our “Growth Engine” plans, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By subscribing to WebLitchi, you confirm that you are at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or the business entity you represent.

2. Service Description

WebLitchi provides “Website as a Service” (WaaS). This means we do not sell you a static product; we sell a subscription to a digital infrastructure. This includes:

  • Website Design & Development based on our proprietary frameworks.

  • Managed Cloud Hosting (via AWS/Third-party providers).

  • SSL Security & Daily Maintenance.

  • Content Updates (Text/Image swaps).

3. Subscription & Payments

3.1. Billing Cycle

  • Monthly Plan: Billed every 30 days via Stripe.

  • Quarterly “Founder” Plan: Billed every 3 months.

  • Automatic Renewal: Services renew automatically unless cancelled before the next billing date.

3.2. The “Founder’s Offer” (No Setup Fee) For a limited time, the standard Setup Fee ($199) is waived for clients who choose the Quarterly Plan ($297 upfront). This waiver is conditional on the initial 3-month commitment.

3.3. Late Payments If a payment fails, we will attempt to retry the charge. If payment is not received within 7 days of the due date, your website will automatically enter “Suspended Mode” (visible only to you, not the public). If payment is not received within 30 days, the account may be terminated and data deleted.

4. Cancellation & Refunds (The “Risk-Free” Promise)

4.1. The 30-Day Money-Back Guarantee If you are a new client and are unsatisfied with our service for any reason, you may request a full refund within 30 days of your initial payment. Send an email to support@weblitchi.com, and we will refund 100% of your subscription fees. No questions asked.

4.2. Cancellation Policy (No Long-Term Contracts) Unlike other agencies, we do not lock you into 2-year contracts.

  • You may cancel your subscription at any time.

  • Cancellation becomes effective at the end of your current billing cycle.

  • Note: We do not provide pro-rated refunds for unused days in a billing cycle (except during the initial 30-day guarantee period).

5. Intellectual Property & Ownership 

5.1. What YOU Own:

  • You own your Domain Name (URL).

  • You own your Logo, Brand Assets, and Written Content.

  • You own your Customer Data and Leads.

5.2. What WE Own:

  • WebLitchi retains ownership of the Source Code, the Design Framework, the Templates, and the Custom Plugins used to power your site.

  • The License: Your subscription grants you a non-exclusive, revocable license to use our design and code while your subscription is active.

5.3. Leaving WebLitchi: If you cancel, your license to use our design expires. You cannot “export” the WebLitchi design theme to another host (e.g., GoDaddy or Bluehost) because it is built on our proprietary stack. You can export your text, images, and SEO data to take with you.

6. User Responsibilities

You agree not to use WebLitchi to host:

  • Illegal content or content that promotes hate speech/violence.

  • Adult/Pornographic material.

  • Malware, phishing scams, or spam.

  • Violation: We reserve the right to terminate any account immediately without refund if it violates these standards.

7. Limitation of Liability

7.1. Service Uptime We utilize enterprise-grade hosting (AWS/Google Cloud) to aim for 99.9% uptime. However, we are not liable for temporary outages caused by third-party providers, natural disasters, or internet-wide disruptions.

7.2. Damages To the maximum extent permitted by law, WebLitchi is not liable for any indirect, incidental, or consequential damages (including lost profits or lost leads) arising from the use of our service. Our total liability is limited to the amount you paid us in the last 3 months.

8. Third-Party Tools

We use third-party tools (such as Stripe for payments, Google for maps, etc.) to provide our service. By using WebLitchi, you acknowledge that your data may be processed by these trusted partners in accordance with their own Privacy Policies.

9. Changes to Terms

WebLitchi reserves the right to update these Terms at any time. If we make material changes (e.g., increasing prices), we will notify you via email at least 30 days in advance.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of USA. Any disputes arising from these terms will be resolved in the courts of Chicago.
